ట్రిబ్యునల్ నుండి ఆర్డర్ తెచ్చుకున్న వారందరికి ప్రమోషన్ ఇవ్వాలా?

"to consider to case of the applicants for promotion to the post of School Assistant in the vacancies that arose prior to 05.02.2017, if they are otherwise eligible and qualified,  as per pre amended Rules issued in GO MS No.15, Education department dated: 05.02.2017

       దీనిలో Tribunal చెప్పిందేమంటే, కోర్టును approach అయిన వారికి, GO. MS.No: 15, Dated:05.02.2017 కు ముందున్న రూల్స్ ప్రకారం అన్ని రకాల అర్హతలు ఉంటే  ( Qulifications ప్రకారం, Seniority ప్రకారం, Vacancies ప్రకారం ) వారిని కూడా పరిగణనలోనికి తీసుకొమ్మని చెప్పింది. Qulifications, Seniority, Vacancies ని బట్టి అర్హులైన వారందరికీ ప్రమోషన్ ఇవ్వాలి అంతే కానీ.... కోర్టుకి వచ్చిన వారందరికీ తప్పనిసరిగా ప్రమోషన్ ఇవ్వాల్సిందే అని Tribunal ఎక్కడా చెప్పలేదు.

2.From  the  Commissioner  of School Education,  A.P., Ibrahimpatnam.    Lr.Rc.No.1178/Estt.IV/2016, dt.02.12.2016  & 01.02.2017.

O R  D E R: :
    In the  circumstances  reported  by  the Commissioner  of  School  Education, Andhra Pradesh  in  the  second  read above,  the  Government  after careful  examination of  the  matter,  have  decided  to  make  certain  amendments  to  the Andhra  Pradesh School  Educational  Subordinate  Service Rules  for  the posts  of  teachers  in  Mandal Prajaparishad and Zilla Prajaparishad Schools  in  Andhra  Pradesh issued  in G.O.Ms.No.12,  School  Education (Ser.II)  Dept., dated  23.01.2009  in  the  first  read above.

2.   Accordingly,  the following  notification  shall  be  published  in  the  Andhra Pradesh Gazettee.

NOTIFICATION 

    In exercise  of  the powers  conferred by  Section  78  and  Section  99  of  the Andhra  Pradesh Education Act,  1982  (Andhra  Pradesh Act 1 of  1982) and  proviso to article  309  of  the Constitution  of  India  and  of  all  other  powers  here  unto  enabling, the  Government  of  Andhra  Pradesh  hereby  makes  the following  amendments  to the Andhra  Pradesh  School  Educational Subordinate  Service  Rules  for  the posts of teachers  in  Mandal  Prajaparishad  and  Zilla Prajaparishad  Schools in Andhra  Pradesh issued  in  G.O.Ms.No.12,  School  Education  (Ser.II)  Dept.,  dated  23.01.2009  and  as subsequently  amended  from  time  to  time. 

    The amendment  shall come  into  force  with  immediate  effect.

AMENDMENTS 

I. In the  said  Rules,  
In  column  4  of  the  table,  in  rule  2,  the following  shall  be  substituted  in respect  of  categories  1  to 17 of  Class.I  :-

“(i) By  Direct  Recruitment;
or 
(ii)  By  Promotion,  - 

(a)  from  the respective  categories  3  to  13  of  Class.II 
    for  the  categories  6 to 16 of  Class.I
and
(b)  from  the  categories  1,  2 and  14  to  25  of  Class.II 
    for  categories  1  to  5  and 17  of Class.I” 

II.    The words  “except city  of  Hyderabad”  occurring  in rule  9 shall  be  deleted.
