Attention of all the District Educational Ofcers & Ex- Ofcio District Project Coordinators and all the Additional Project Coordinators of Samagra Shiksha in the State is invited to the references cited and are informed that the Additional Secretary of Department of School Education and Literacy, Ministry of Education, New Delhi requested for maintaining of pupil teacher ratio (CwSN: Special Educators) in Elementary and Secondary schools vide  reference 1st cited. 

In the reference 2nd cited, the Government of India issued orders for providing various provisions to Children with Special Needs in Rights of Persons with Disabilities Act-2016. The Act clearly stated that I) admit children with special needs without discrimination and provide education and opportunities for sports and recreation activities equally with others and II) ensure that the education to persons who are blind or deaf or both is imparted in the most appropriate languages and modes and means of communication in chapter-III 

In point number 31 (I) in Chapter-VI of RPWD act-2016 it is mentioned that “notwithstanding anything contained in the Rights of Children to Free and Compulsory Education Act, 2009, every child with benchmark disability the age of Six to eighteen years shall have the right to free education in a neighborhood school, or in a special school of his choice which was mentioned in point number 31 (I) in Chapter-VI of RPWD act-2016”. 

Inclusive education is a human right issue. Every child with special needs has a right to receive education in the neighborhood school. Therefore every school is an inclusive school. The right to education in the neighborhood school is granted to every child with special needs. 

Section 3 of the Right of Children to Free and Compulsory Education (RTE) Act, 2009 provides for free and compulsory education to all children from 6-14 years of age. This also includes children with learning disabilities. Clause (c) of sections 8 and 9 of the Right of Children to Free and Compulsory Education (RTE) Act, 2009 casts a duty on the appropriate Government and local authority to ensure that the child belonging to weaker section and the child belonging to disadvantaged group are not discriminated against and prevented from pursuing and completing elementary education on any ground. 

It came to know that some of the Head Masters of the Primary Schools and High Schools are not allowing for admissions of CwSN which is discrimination on the guidelines issued by Rights of Persons with Disabilities Act-2016. 

Guidelines regarding Admission of Children with Special Needs 

• Every identified Children with Special Needs in the age group of 6 to 18 years shall be enrolled in the neighborhood schools without any discrimination. 

• Every Children with Special Needs shall be enrolled in classes according to their age. • No child shall be denied admission in school due to absence of related documents. 

• The Children with Special Needs shall be enrolled throughout the academic year. 

• It is mandatory to mention regarding the placement of CwSN such as Bhavitha Center, Home Based Education against his/her name in the admission forum/attendance register. 

• A separate register shall be maintained for the students under Home Based Education in every school for their coverage report/attendance. 

• Attendance will be exempted to CwSN who are sufering with severe/Profound disabilities and bedridden children (100% disability mentioned in the SADAREM Certificate). 

Therefore all the DEOs/APCS are requested to issue instructions to all strict the Head Masters of Primary and High Schools not to show any discrimination for providing admissions to CwSN in Government and Government Aided Schools duly following the Rights of Persons with Disabilities Act-2016.
