CIRCULAR MEMO

Sub:  Police - Registration of F.I.R.s - Certain Instruction - Issued - Reg.
Ref:
1) Sec. 154 Cr.P.C. of 1973
2) Sec. 166 (A) & 217 IPC
3) Police Standing Order No. 409 (A) 1, 2, 3, 4 10 (2) of APPM, Part-I, Vol-II (A).
4) Hon'ble Apex Court ruling in Lalita Kumari V. State of UP (2014)[2].
5) Hon'ble High Court of Karna taka, Judgement in WP.No. 30666/ 2019, dtd :  19.9.2019.

    It is observed that when public are approaching the Police Station for registration of their cases. Often they are being directed to go to other Police Stations on point of territorial jurisdiction which is not correct.

    Vide reference 5th cited, there are specific directions on registration of
F.I.R in the Police Station which are reiterated below.

1. Even if the alleged offence has been committed outsid e the territorial Jurisdiction of the Police Station. FIR shall still be registered and the same shall be transferred to appropriate Police Station.

2. The Police Officers should be clearly informed that fa ilure to comply with the d irection of registration of FIR and a receipt of information about cognizable offence  may invite prosecution of the Police Officer under section 166-A of IPC and it may also invite departmental action against them.

    PSO 409 (A) - 3, 4 10 (2)of APPM, Part-I, Volume-II (A) , Sec. 154 Cr.P.C
also speaks about registration of FI R.

Hence, all the unit officers are hereby directed to communicate this order to all their subordinate Police Officers and police stations to scrupulously abide by the directions of the Hon'ble Apex Court ruling in Lalita Kumari V. State of UP (20 14) and also the above police standing orders mentioned in the APPM. Disciplinary action will be initiated against erring officers for noncompliance.

    All will acknowledge the receipt of this memo in wiiting.
